The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020

The 2020 Regulations apply to all private rented properties in Leeds. Landlords must obtain an EICR documented in accordance with BS 7671:2018+A4:2026 (Part 6, Chapter 64 — Regulations 641–651) before a new tenancy begins and at least every five years.

  • Mandatory EICR — required before new tenancies and every five years for existing tenancies. Applied to all tenancies from 1 April 2021.
  • Tenant copies — existing tenants within 28 days, new tenants before moving in.
  • Council copies — within seven days if requested by Leeds City Council.

Leeds City Council Enforcement

Leeds City Council has a dedicated private rented sector team within its housing standards service. The council takes a proactive approach to enforcement, particularly in areas with high concentrations of privately rented properties.

  • Selective licensing — Leeds operates selective licensing in designated areas. A valid EICR is a mandatory licence condition. Areas include parts of Harehills, Beeston, and Holbeck where the private rented sector is substantial.
  • Student areas — Headingley, Hyde Park, Woodhouse, and Burley have high concentrations of student HMOs. Leeds City Council actively enforces HMO licensing and electrical safety compliance in these areas.
  • Complaint investigation — the council investigates tenant complaints and can require landlords to obtain an EICR and complete remedial work. Failure to comply results in civil penalties.

HMO Additional Requirements in Leeds

Leeds has a large student population supporting a substantial HMO market. The student areas of Headingley, Hyde Park, and Woodhouse contain hundreds of HMOs, many in converted Victorian and Edwardian terraced houses.

  • Mandatory HMO licensing — properties with five or more occupants in two or more households. Valid EICR is a licence condition.
  • Back-to-back terraces — Leeds has a unique stock of back-to-back terraced houses, many converted into HMOs. These properties often have limited access for inspection, older wiring, and inadequate earthing. FI (Further Investigation) observations are common where wiring is concealed and inaccessible.
  • Fire safety — HMO fire alarm and emergency lighting systems must be tested as part of the EICR. RCD protection (Regulations 411.3.3 and 411.3.4) is particularly important in shared properties.
  • Arc fault detection (A4:2026) — Regulation 421.1.7 recommends the installation of arc fault detection devices (AFDDs) on AC final circuits to mitigate fire risk from arc fault currents. For older Leeds HMOs where wiring condition is unknown, electricians should raise AFDDs as a recommended upgrade for landlords.

Penalties for Non-Compliance

Leeds City Council can impose civil penalties of up to £30,000 per breach.

  • Up to £30,000 per breach — each failure is separate. Multiple penalties can be imposed for the same property.
  • Section 21 restrictions — no valid Section 21 notice without providing the EICR.
  • Licensing offences — operating an unlicensed HMO or property in a selective licensing area is a criminal offence with an unlimited fine.

  • Right to a copy of the EICR — within 28 days for existing tenants, before moving in for new tenants.
  • Report non-compliance — contact Leeds City Council's housing standards team. The council can investigate and take action.

Remedial Work Timescales

  • C1 — immediate action required — a C1 (danger present) observation means risk of injury exists. The installation or circuit must be made safe immediately; the 28-day window does not apply. The landlord must act before tenants are re-exposed to the danger.
  • C2 — 28 days maximum — a C2 (potentially dangerous) observation must be remedied within 28 days of the EICR date, or sooner if the inspector specifies.
  • Common remedial work in Leeds — RCD protection (Regulations 411.3.3 and 411.3.4), consumer unit replacements, earthing upgrades on older terraces, and rewiring of deteriorated cables.
