    Why: Part 1 (regulations 1 to 3) holds the definitions in regulation 2, including asbestos, AIB, licensable work, short duration work and the control limit. Part 2 carries the duties, such as regulation 11 on preventing exposure, so it is the tempting wrong answer. Part 3 covers prohibitions, and Part 4 (regulations 29 to 35) covers exemption certificates and other general matters.

  2. 02A toolbox talk handout says the asbestos control limit is averaged over a full 8-hour shift. What averaging period does regulation 2 actually set?
    • AAny 10 minutes of the work
    • BA rolling 7-day working week

    Why: Regulation 2 defines the control limit as 0.1 f/cm³ averaged over a continuous period of 4 hours, for every type of asbestos. It is not an 8-hour average, which is the mistake in the handout. Ten minutes is the measuring period for the separate 0.6 f/cm³ figure, and 7 days belongs to the short-duration rule, not the control limit.

  3. 03You are drilling in an office while staff carry on working nearby. Under regulation 3(3), whose safety do your employer’s CAR 2012 duties also cover?
    • AOnly the client who booked and is paying for the job
    • BOnly its own employees doing the drilling work
    • COnly people who hold asbestos awareness training
    • DOthers affected, such as occupants and other trades

    Why: Regulation 3(3) extends an employer’s duties, so far as is reasonably practicable, to any other person who may be affected by its work, whether at work or not, such as building occupants and other trades. Limiting the duty to your own staff is the tempting mistake. Whether someone has awareness training, or is the paying client, does not decide whether the duty reaches them.
