Sample questions

  1. 01A main contractor’s planner asks which part of the Confined Spaces Regulations 1997 requires rescue arrangements to be prepared before entry. Which is it?
    • ARegulation 4(1), avoiding entry
    • BRegulation 5, emergency arrangements
    • CRegulation 1(2), the definitions
    • DRegulation 3, duties of employers

Why: Regulation 5(1) says no person at work shall enter or carry out work in a confined space unless suitable and sufficient arrangements for rescue from that space have been prepared. Regulation 4(1) is the separate duty to avoid entry where reasonably practicable, regulation 1(2) holds the definitions, and regulation 3 says who must comply.

  2. 02A firm’s rescue plan for a deep tank is photocopied and used unchanged for a shallow cable chamber with a different opening on another site. What is the main problem?
    • ARescue plans may only be written by the fire service
    • BPhotocopies of safety documents are not allowed on site
    • CReg 5 needs arrangements prepared for that space
    • DA rescue plan can only be used once and then filed

Why: Regulation 5(1) requires arrangements prepared "in respect of that confined space", and the ACOP says they depend on the type of space, the risks found and what a rescue from it would probably involve. A deep tank plan may not fit a different opening, depth or hazard. Copying is not the issue in itself, and nothing limits who writes a plan to the fire service.

  3. 03Forced ventilation keeps the air in a plant room chamber safe, so the supervisor says regulation 5 no longer applies while the fan runs. Why is that wrong?
    • AIt is right, if the fan is checked every hour
    • BIt is right, as long as the fan has a backup supply
    • CRegulation 5 applies only to spaces below ground level
    • DThe Regulations still apply and reg 5 covers any emergency

Why: HSE guidance in L101 says that once a space is identified as a confined space the Regulations apply in full, even where the specified risk is controlled. Regulation 5(1) also covers an emergency whether or not it arises out of a specified risk, such as a fall or someone being taken ill. A backup supply for the fan does not remove the need for rescue arrangements, and regulation 5 is not limited to spaces below ground.
