Sample questions
01Which law were the Confined Spaces Regulations 1997 made under?
- AThe Health and Safety at Work etc. Act 1974
- BThe Building Regulations made in England
- CThe Electricity at Work Regulations 1989
- DThe Factories Act 1961 and its later orders
Why: The Confined Spaces Regulations 1997 were made on 17 July 1997 under powers in the Health and Safety at Work etc. Act 1974, and came into force on 28 January 1998. The Electricity at Work Regulations 1989 are a separate set of regulations that deal with electrical danger; they are not the parent law of the confined space rules.
02Reading the printed L101, how can you tell which paragraphs are the Approved Code of Practice?
- AThey are printed inside a coloured box
- BThey are printed in italic type
- CThey are printed in bold type
- DThey are printed in normal type
Why: In the printed L101 the Regulations are in italics, the ACOP is in bold and the HSE guidance is in normal type. Italic text is the law itself, which is why it is the most tempting wrong answer; the bold ACOP paragraphs are the ones with the special legal status.
03A client’s confined space procedure says its own permit form "replaces" the Regulations on its site. How should you view that?
- AThe Regulations only apply where there is no procedure
- BThe procedure has the same status as the ACOP
- CThe procedure sits under the law, never above it
- DThe client’s procedure overrides the law on site
Why: The Regulations are the law, made under the 1974 Act. A client’s procedure, a permit form or a training card all sit underneath them and cannot switch them off. Nor does a client’s procedure have ACOP status: only the bold ACOP paragraphs in L101, approved by HSE, carry that.
