Sample questions
01Your firm takes on a fit-out of an office in Glasgow. Which law sets the general fire safety duties for that job?
- APart 3 of the Fire (Scotland) Act 2005 and its regulations
- BNo fire law at all, as the work is only a short fit-out
- CThe Fire Safety Order, but enforced by HSE in Scotland
- DThe Fire Safety Order, as it covers all of Great Britain
Why: The Fire Safety Order says it extends to England and Wales only. HSE explains that in Scotland general fire safety is covered by Part 3 of the Fire (Scotland) Act 2005, supported by the Fire Safety (Scotland) Regulations 2006. The Order does not reach Scotland under a different enforcer, and a short job is not outside fire law.
02Which group of people does the Order leave out of its definition of "relevant persons"?
- AMembers of the public lawfully using the premises
- BVisiting contractors who are working on the premises
- CFirefighters while carrying out their fire and rescue duties
- DNeighbours in the immediate vicinity at risk from a fire
Why: Relevant persons are anyone who is or may be lawfully on the premises, and anyone in the immediate vicinity at risk from a fire there. The Order excludes firefighters while they carry out their fire and rescue duties. Contractors, the public and neighbours at risk are all inside the definition.
03You are fitting a new supply to a detached garage used only by the family who live in the house beside it. Does the Fire Safety Order apply to the garage?
- AYes, because the garage is a separate building from the house
- BOnly while the electrician is working inside the garage itself
- CNo, a garage that goes with a private home is domestic premises
- DYes, because any garage counts as a workplace under the Order
Why: The Order defines domestic premises as premises occupied as a private dwelling, including a garage or outhouse that is not used in common by more than one dwelling, and article 6 leaves domestic premises out. Being a separate building does not change that, and your being there as a contractor does not make it a workplace under the Order.
