Sample questions
01Two electricians argue over a first-aid rule they heard at a toolbox talk. Where would they find the actual law on first aid at work?
- AIn a first-aid manual from a voluntary aid society
- BIn the Health and Safety (First-Aid) Regulations 1981
- CIn the HSE leaflet on basic advice on first aid at work
- DIn L74, the HSE book called "First aid at work"
Why: The law on first aid at work is the Health and Safety (First-Aid) Regulations 1981 themselves. L74 is HSE guidance on those Regulations: following it will normally be enough to comply, but it is not the law. HSE leaflets and voluntary aid society manuals are guidance and practice, not legal duties.
02At lunchtime a plumber on a shared site suddenly feels very unwell with an illness that has nothing to do with the job. Does that fall within first aid at work?
- ANo, illnesses are a matter for the worker’s own doctor
- BYes, HSE says the cause does not matter, only prompt help
- CYes, but only once a doctor has first confirmed what caused it
- DNo, first aid at work only covers injuries caused by work
Why: HSE says it makes no difference whether the work caused the injury or illness: what matters is that the person gets immediate attention and that an ambulance is called in serious cases. Regulation 2 also speaks of injury and illness, so illness is not excluded.
03Which general duty in the Health and Safety at Work etc. Act 1974 sits behind the First-Aid Regulations?
- ASection 2(2)(e), welfare facilities for the general public
- BSection 2(2)(e), welfare facilities and arrangements for staff
- CSection 7, the duty on each employee to wear PPE at all times
- DSection 3, the duty to give every member of the public first-aid training
Why: Section 2(2)(e) requires an employer, so far as is reasonably practicable, to provide a working environment that is adequate as regards facilities and arrangements for employees’ welfare at work. The First-Aid Regulations are the specific rules for first aid. Section 2(2)(e) is about employees, not the general public.
