Sample questions
01Which statement about how the Work at Height Regulations define work at height is correct?
- ANo minimum height; it turns on whether a fall could injure
- BIt applies only once the platform is above guard rail height
- CIt covers the work position but never the route to and from it
- DIt starts at 2 m, the figure used for construction platforms
Why: Work at height is any place, even at or below ground level, where without precautions someone could fall far enough to be injured, and there is no minimum height in the definition. The 2 m figure is tempting, but it belongs to the reg 12 inspection rule for construction platforms, not to the definition. Getting to and from the place counts too, except by a staircase in a permanent workplace.
02You are checking the plates on a scissor lift delivered for a lighting job. Apart from the safe working load, what must LOLER reg 7 have marked on it?
- AA maximum wind speed set by the regulations
- BThe date it was last serviced by the hire company
- CThat it is designed for lifting persons
- DThe name of the operator familiarised on it
Why: LOLER reg 7 requires lifting equipment designed for lifting persons to be clearly marked to show this, alongside the safe working load. Expecting a wind speed from the regulations is the tempting error: no regulation sets one, and the wind limit is the manufacturer’s figure for that machine. Servicing dates and operator names are not reg 7 markings.
03High-level cable can be run either from a guarded MEWP platform or by a worker on a beam clipped on with a harness. What does WAHR reg 7 say about the choice?
- ACollective protection gets priority over personal protection
- BThe cheaper option, as long as a risk assessment is written
- CPersonal protection first, as it is worn by the person at risk
- DEither is fine, as both options are lawful ways of working
Why: Reg 7 says collective protection, such as a guarded platform that protects everyone in it without anyone having to do anything, gets priority over personal protection such as a harness. Putting the harness first because it is worn by the person at risk is the tempting mistake, but it reverses the order the regulation sets. The choice must also weigh conditions, the fall, duration, rescue and the risks of the kit, not cost alone.
